Abstract

The criterion relating to the responsibility for the costs of proceedings in Administrative Appeals Court implemented by Law 37/2011, of October 10, of measures of procedural agility, institute characterized by the dispersion of criterion in the judicial praxis and a fearful uncertainty for lawyers, in the event of a negative outcome of the lawsuit, both on whether to assume the costs,
and in what amount and concepts. It aims to expose the legal scenario and the procedural paths of the figure along with possible interpretations or pragmatic proposals to redirect it to greater guarantees of effective judicial protection.
